Chicago, Illinois Jan 8, 2020 (Issuewire.com) - The Law Offices of Jeffery M. Leving Ltd. won an important court victory for a devoted dad whose daughter was reportedly being physically beaten.

The girl, not even school-age yet, was living with her mother. According to court documents, the mother took the girl out of state for a stay with the mother’s new boyfriend – a visit the father did not approve.
When they returned, and the father picked up his daughter for a regularly-scheduled visit, the girl reportedly complained of pain. The father, according to court records, checked it out and found bruises and red marks on his young daughter’s back, shoulder and behind. The girl reportedly told her dad that her mother’s new boyfriend was hitting her. Dad took his daughter to the hospital, and the police and the Department of Children and Family Services were called.
The situation was dire: Children are sometimes beaten to death. The firm had to act fast to get this little girl out of peril.
The Leving legal team was already representing the father in court, working out a parenting agreement. But once they got word of this, they jumped into action to protect the girl. The Leving team, led by attorneys Michael Ochoa and Percy Mitchell, filed for an emergency order of protection. While that request is pending, the judge immediately ordered the girl out of the mother’s custody and placed her with her loving, caring and protective father. The judge also ordered the mother’s boyfriend to have no contact with the girl for any reason.
“We are so relieved that we were able to help this distressed dad and his little girl, and we’re glad the judge made this decision,” Leving said.
In his book Fathers’ Rights, Leving points out that a parent has the right and the duty to protect his child from harm – and to use the court system to do so. A father who becomes aware of dangerous conditions at the mother’s home, including a new boyfriend or stepfather who causes harm, can and should ask the court to remove the child from this situation. Ultimately, if the court sees evidence that the children are seriously endangered, the court can award sole custody to the parent with the safe home and can place severe restrictions on the visitation rights of the parent whose home endangers the child. Child abuse in any form meets that standard of “serious endangerment.”
